The Public Employees’ Retirement System of Mississippi (PERS) Board met this past Tuesday and rescinded its regulation which allowed retirees to serve in the legislature while drawing their retirement benefits. The board revised Regulation 34, Reemployment after Retirement, in December 2019 to allow state retirees to serve in the Mississippi Legislature and draw their retirement benefits. As we shared in May, the IRS declined to rule on the agency’s private letter ruling request about these revisions. This contributed to the board’s vote Tuesday to revert back to Regulation 34’s original language prior to the December revisions. Tuesday’s revisions will go out for public comment, so the public will have an opportunity to share their thoughts on this issue with the PERS Board.
